WELLNESS COACHING & PERSONAL TRAINING AGREEMENT
Thank you for choosing us as a part of your commitment to health and wellness. With our guidance, you will improve your ability to accomplish your goals faster, safer, and with maximum benefits. The details of these sessions can be used for a lifetime.
This Agreement is made today between The New Standard Wellness Coaching and the person named at the end of this document, [the Client].
Duration: This program requires a 6-month commitment from the Client.
MIND Package: Includes one weekly coaching session (virtual or in-person) with on-demand support in between sessions via text/email.
BODY Package: Includes two weekly workout sessions and one weekly nutrition coaching session (virtual or in-person) with on-demand support in between sessions.
ULTIMATE Package: Combines both MIND and BODY packages, includes an extra workout session per week, and offers on-demand phone calls in addition to text/email access.
PAYMENT & FEES:
Cost: MIND - $125/week, BODY - $149/week, ULTIMATE - $249/week.
No Refunds: Once this contract is signed, no refunds will be provided under any circumstances.
Early Termination: If the Client decides to terminate the contract before the completion of the 6-month term, a cancellation fee of $149 will be charged.
Rescheduling: If the Client needs to reschedule a session, they must provide at least 24 hours' notice. Any session rescheduled with less than 24 hours' notice will incur a rescheduling fee of $35.
Missed Sessions: Sessions that are missed without prior notice will be forfeited and cannot be made up at a later date.
The Coach will keep the Client’s information private and will not share the Client’s information with any third party unless compelled to by law.
LIABILITY & DISCLAIMERS:
Medical Disclaimer: The Trainer/Coach is not a medical professional and does not provide medical advice, diagnosis, or treatment. The Client should consult with healthcare professionals before making any significant changes to their health or fitness routines.
Assumption of Risk: The Client acknowledges that exercise and coaching have inherent risks and agrees to assume all risks associated with participation in the program. This includes, but is not limited to, risks of physical injury, mental distress, and unforeseen hazards.
Waiver & Release: The Client hereby releases, waives, discharges, and covenants not to sue the Trainer/Coach, its officers, employees, and agents from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by the Client, or any property belonging to the Client, whether caused by the negligence of the Trainer/Coach or otherwise, while participating in the program.
Indemnification: The Client agrees to indemnify and hold harmless the Trainer/Coach, its officers, employees, and agents from any loss, liability, damage, or costs, including court costs and attorney fees, that they may incur due to the Client's participation in the program, whether caused by the negligence of the Trainer/Coach or otherwise.
No Guarantees: The Trainer/Coach makes no guarantees or warranties, express or implied, regarding any results or outcomes from the Client's participation in the program.
Emergency Medical Treatment: The Client grants the Trainer/Coach permission to obtain emergency medical treatment for the Client if deemed necessary by the Trainer/Coach, and the Client agrees to be financially responsible for any costs incurred as a result of such treatment.
ARBITRATION, CHOICE OF LAW, AND LIMITED REMEDIES:
In the event of a dispute between Coach and Client, the parties agree to submit to binding arbitration before the American Arbitration Association. This agreement shall be construed according to the laws of the State of Texas.
If the terms of this Agreement are acceptable, please sign below. By doing so, the Client acknowledges that they have received a copy of this agreement, had an opportunity to discuss its contents with the Coach, and agree to abide by its terms.
